Hawaii Police Commission <br />Meeting Agenda <br />September 16, 2016 <br />Page 2 <br />(CLOSED SESSION AT APPROXIMATELY 10:00 A.M.) <br />EXECUTIVE SESSION (Closed to the public.) <br />The commission will meet in executive session to consult with Corporation Counsel on <br />questions and issues pertaining to the commission's powers, duties, privileges, immunities, <br />and liabilities; to consider discipline and charges against officers or employees of the <br />Hawaii Police Department; and to consider sensitive matters relating to public safety <br />pursuant to HRS 92-5 (a) (2) (4) (6) and the Hawaii County Charter Section 13-20 (b). <br />(Complaints are briefly summarized.) <br />• Reconsideration of Complaint HPC 16-24: Complainant alleged that it was a <br />violation of her privacy when an officer responded to a request to check on her welfare. <br />The commission found insufficient evidence of misconduct. Complainant requested a <br />reconsideration of the commission's decision. <br />• Consideration and Investigation of Complaints <br />✓ Complaint HPC 16-20: Complainant alleged that when an officer responded to a <br />call, he was biased and unprofessional. <br />✓ Complaint HPC 16-21: Complainant complained about the manner in which an <br />officer conducted a traffic stop. <br />✓ Complaint HPC 16-27: Complainant alleged that her vehicle was illegally searched. <br />✓ Complaint HPC 16-29: Complainant alleged that an officer's response to her stolen <br />marijuana plant was unprofessional. <br />✓ Complaint HPC 16-30: Complainant alleged that when he made a complaint, an <br />officer had a conflict of interest. <br />✓ Complaint HPC 16-31: Complainant alleged that when an officer responded to her <br />complaint, he had a bad attitude and criticized her. <br />✓ Complaint HPC 16-32A, 16-32B: Complainants alleged that an off-duty officer <br />followed them very closely and aggressively. They also alleged that during the <br />traffic stop the officer used profanity at them and bullied them into agreeing with her. <br />• Consideration of Complaints Received After the 90 -Day Filing Deadline: The <br />Commission will only determine whether to accept or decline investigation. If it is <br />accepted, it will be placed on a subsequent agenda. <br />✓ Complaint HPC 16-34: Complainant requested an exception to the 90 -day rule <br />because he needed assistance with filing the complaint. <br />
