A NIMALS § 4-1-1
<br />“Substantial bodily injury” means bodily injury which causes:
<br />(1) A major avulsion, laceration, or penetration of the skin;
<br />(2) A burn of at least second degree severity;
<br />(3) A bone fracture;
<br />(4) A serious concussion; or
<br />(5) A tearing, rupture, or corrosive damage to the esophagus, viscera, or other
<br />internal organs.
<br />“Vicious dog” means a dog which:
<br />(1) Places a person or other animal in imminent danger of bodily injury; or
<br />(2) Has bitten any person or animal.
<br />A dog shall not be deemed vicious where the vicious behavior in question is the
<br />result of the dog being tormented, assaulted, or otherwise abused by the victim of
<br />the vicious behavior.

<br />Article 2. Dog, Cat, and Animal Pounds.
<br />Section 4-2-1. Pound established for dogs, cats, and domesticated animals.
<br />The animal control and protection agency may establish pounds for the purpose of
<br />impounding, caring for, sheltering, and disposing of unlicensed, lost, stray, homeless, or
<br />diseased dogs, cats, or any seized animals not redeemed in the County of Hawai‘i.

<br />Section 4-2-2. Direction, control, and administration of pound.
<br />Each pound shall be under the direction, control and administration of the animal
<br />control and protection agency which shall, in addition to the duties provided in section
<br />4-2-1, feed and shelter the dogs, cats, and domesticated animals in their care pursuant
<br />to chapter 143, Hawai‘i Revised Statutes.

<br />Section 4-2-3. Power to seize and impound dogs, cats, and domesticated
<br />animals.
<br />The County animal control and protection agency shall be authorized to seize and
<br />impound any dog, cat, or other domesticated animal, when such dog, cat, or other
<br />domesticated animal is a stray, and to dispose of such dog, cat, or domesticated animal
<br />in accordance with chapter 143, Hawai‘i Revised Statutes, as amended.
