§ 33-31 HAWAII COUNTY CODE <br /> Section 33-31. Refunding bonds. <br /> (a) Tax increment refunding bonds issued for the refunding of the outstanding <br /> indebtedness of any tax increment district shall bear the name of the tax increment <br /> district for which they are issued, and shall be issued and sold under all the <br /> conditions and terms as prescribed by article 4 of this chapter, except as otherwise <br /> provided in this chapter. <br /> (b) A different rate of interest than that authorized in the original issue of tax <br /> increment bonds may be prescribed and the tax increment refunding bonds may be <br /> authorized to run for a term exceeding thirty years from the date of their issuance <br /> or fifteen years from the final maturity date of the tax increment bonds being <br /> refunded. <br /> (c) If the final maturity date of the tax increment refunding bonds exceeds the final <br /> maturity date of the tax increment bonds being refunded, the council shall, if <br /> necessary, pass an ordinance amending the original ordinance passed in accordance <br /> with section 33-11 to change the termination date of the district to coincide with the <br /> final maturity of the tax increment refunding bonds. Such ordinance shall be <br /> passed by the council prior to the issuance of such refunding bonds. <br /> (1994, ord 94-76, sec 3.) <br /> Section 33-32.
