BUSINESS IMPROVEMENT DISTRICTS § 35-43 <br /> Section 35-43. Duration of hearing; determination. <br /> The hearing may be continued from time to time, but shall be completed within <br /> thirty days; except that, if the council finds that the complexity of the proposed <br /> annexation or the need for public participation requires additional time, the hearing <br /> may be continued from time to time for a period not to exceed ninety days from the date <br /> of the original hearing. At the conclusion of the hearing, the council, after considering <br /> all protests and such other relevant factors (such as the general plan or development <br /> plan) as it deems appropriate, may approve or disapprove the ordinance of annexation <br /> (in the form in which it was introduced or with such changes as determined by the <br /> council and permitted by this part). Thereafter, the County may levy the assessment on <br /> the annexed land. <br /> (2004, ord 04-94, sec 1.) <br /> Section 35-44. Filing of notice. <br /> After the effective date of an ordinance of annexation, the director of finance shall <br /> provide notice of any assessment change or levy in the manner specified under <br /> section 35-25. <br /> (2004, ord 04-94, sec 1.) <br /> Article 6. Proceedings to Terminate a District. <br /> Section 35-45. Authorization to terminate the district. <br /> (a) The council may terminate a district at any time for cause due to the willful <br /> misconduct or gross negligence on the part of the district board. The council shall <br /> initiate proceedings to terminate the district for cause by a resolution and shall <br /> terminate the district by an ordinance. <br /> (b) The council, on its own initiative, may terminate a district at the expiration of the <br /> then occurring five-year term in accordance with this article. The council shall <br /> initiate proceedings to terminate a district at the expiration of the then occurring <br /> five-year term by a resolution and shall terminate the district by an ordinance. <br /> (c) The council may terminate a district at any time upon request from the district <br /> board. A termination shall be accomplished in accordance with this article. <br /> (d) Except as set forth herein, the council may not initiate proceedings to terminate a <br /> district. <br /> (2004, ord 04-94, sec 1.) <br /> Section 35-46. Ordinance terminating the district. <br /> (a) Upon its own initiative or receipt of the request from the district board, both as set <br /> forth in sections 35-45, if the council determines that the public convenience and <br /> necessity will be promoted by terminating a district, the council may approve an <br /> ordinance terminating the district. <br /> 35-19 <br />
