Mr. Robinson: Well just for me I mean it's very clear...it says it depends on the <br /> nature of the relationship is disclosed when you provide the bid. <br /> That you disclose that you're a contract employee and that you've <br /> gotten the opinion from the Board that there's no conflict of <br /> interest. It appears to me that requires that every time and if you're <br /> doing contracting with the County that gets to be laborious. I don't <br /> know how...we've talked about that before...if he has to come <br /> back every time he submits a contract. <br /> Ms. Kahakalau: Yeah it's difficult the way it's currently written...it really is very, <br /> very difficult to us to do any kind of standard...Carte Blanc kind of <br /> an approval and that's not because we don't want to...it's just that <br /> the way the code is written...it's just not clear...that's my <br /> understanding I don't know...I'm not a lawyer but... <br /> Mr. Yoshimoto: So for the purposes of this opinion, this opinion will cover any bids <br /> in the future that Mr. Andrade would have with Environmental <br /> Management...would that be safe to say? It may be ridiculous, but <br /> it needs to happen and that's the way it's written...I mean again <br /> with what you're saying as far as waste management...yes I would <br /> love to hear that I won't have to come back if I bid on another <br /> waste management project and maybe some other department I <br /> would have to get the decision...but I would agree with that. <br /> Mr. Adams: I would offer that...the ordinance says that the officer or employee <br /> has to obtain an opinion from the Board that there's no conflict of <br /> interest resulting from position with the County...right...and so <br /> that continues as long as there's no change or until there is a <br /> change in these variety of things including the financial interest or <br /> role in the business or undertaking with what the contract is <br /> concerned. Number one in there is that the nature, relationship is <br /> provided in full disclosure...so if there's a bid made...as long as <br /> that disclosures made and as long as there continues to be an <br /> opinion that's in compliance with the fact pattern that we have <br /> now...then I don't see that that...there's a change associated with <br /> that...that would be my view on this...so I would be supportive of <br /> the opinions saying that this has to do with bids associated with the <br /> Department of Environmental Management. Again we need to <br /> 11 <br />
