Mr. Adams: That would be...in my opinion and I would be interested in <br /> hearing Counsel on this. I believe that would require a subpoena <br /> to do that. <br /> Mr. Murai: Certainly, the parties may agree to appear and if there's no <br /> agreement or if Counsel's not prepared to commit to the client <br /> appearing then the Board could issue a subpoena. <br /> Ms. Kahakalau: Okay. It's been <br /> brought to my attention since I was the one who was arguing it. <br /> That in fact sections in our rules...section 4.7 and 4.8 and 5 would <br /> indicate that due process according to our rules indicates that we <br /> would had a resolution indicating we were gonna have an <br /> investigatory hearing as a part of our infonnal hearing. We have <br /> not done that...their absolutely correct in that regard. Unless we <br /> decide to either continue or dismiss...I have put forward a motion <br /> indicating that we will at some point in November...date to be <br /> determined that has to be determined before the end of this <br /> meeting. Hold such a hearing with notice to both...to all parties. <br /> So that's where we are at the moment...in the middle of discussion <br /> of a motion that I made and member Robinson seconded. <br /> Mr. Goodenow: Alright.
