Everyone has a right to share and be comfortable with
their own ideas.
It's okay to disagree as long as it is done respectfully. If
you need to argue, argue the issue and not against a
person.

Sunshine Law (HRS 92):
Open Meeting Requirement
Purpose
Protect public's right to know
Open governmental process to public participation
Discussions, deliberations and decisions must be
conducted at a meeting
Boards and Committees must provide notice
All items that the Committee intends to consider
So that the public can decide whether to participate in the
meeting
Every meeting must be open
Must accept testimony at the meeting

Steering Committee Conflict of Interest
The Steering Committee members shall act... in
the best interests of the people of Hawaii
County. Whenever a member has a financial,
professional, or personal interest in any matter
coming before the Steering Committee, the
affected person shall
(1) fully disclose the nature of the interest
(z) withdraw from discussion and voting on the
matter.

Scope of CDPs includes:
Designate and coordinate detailed development
patterns
Provide detailed regional policies for land use
Direct physical development
Be a forum for community input into managing growth
May contain detailed land use guide maps

REMEMBER
Zoning determines permitted uses
General Plan LUPAG designations guide future land use
changes; the LUPAG is not Zoning
CDP land use policies represent the community's
preference for future land uses; they do not indicate that
the County is recommending or initiating zoning changes
The CDP makes recommendations to amend the LUPAG,
but an adopted CDP does not automatically change the
LUPAG (General Plan amendments require further
action).
Incases where there is a direct conflict between the
General Plan and a CDP, the General Plan is controlling

regional CDP?
Is the testimony providing substantially new information
that wasn't available prior to this
information change the wav you

understand the issue?
Is the new information verifiable?
Is the testimony supported by the established Community
Objectives?
Is the suggestion consistent with other committee
decisions, and if not, why would this issue be treated
differently?

But, keep in mind:
The CDP Process represents a shift in the
County's approach to planning...
The CDP cannot solve all the issues of Ha- ma- kua: no magic wand
Some issues are too controversial for a CDP: no consensus
Some recommendations by the Steering Committee may be
challenged:
Opportunities for the community to testify on the CDP
continue at Planning Commission and County Council
hearings

The Final Steering Committee Recommendation

How can the Community stay involved??
Action Committee: Proactive community-based steward
of the CDP's implementation
Action Committee Comprised of 9 members & will be
selected from various areas of the community
The qualifications and selection process will be very similar
to the Steering Committee selection process.
Action Committee members will be area representatives
that reflect broad perspectives.
Steering Committee members qualify to apply if they are
interested in helping implement the CDP.
Action Committee appointments are staggered and likely
will involve two, three, and four year terms.
