Hawaii Police Commission <br />Regular Session Minutes <br />December 16, 2016 <br />Page 3 <br />EXECUTIVE SESSION <br />Commissioner Hendricks motioned to meet in executive session to consider discipline <br />and charges against officers or employees of the Hawaii Police Department, to <br />consider sensitive matters relating to public safety, to review the evaluation of an <br />employee, and may consult with Corporation Counsel on questions and issues <br />pertaining to the commission's powers, duties, privileges, immunities, and liabilities <br />pursuant to HRS 92-5 (a) (2) (4) (6) and the Hawaii County Charter Section 13-20 (b). <br />Executive session convened at 9:36 a.m. <br />Regular session reconvened at 12:42 p.m. <br />ACTION ON EXECUTIVE SESSION MATTERS <br />• Investigation of Complaints <br />✓HPC 16-34: Complainant complained of an officer's speeding during his transport. <br />Commissioner Paiva motioned to refer the complaint to the Police Chief for <br />further investigation. Commissioner Hendricks seconded, and it carried <br />unanimously. <br />✓ HPC 16-38: Complainant requested a reconsideration of the commission's <br />decision that there was insufficient evidence to prove the allegations of <br />misconduct. No motion was made to reconsider the complaint. <br />✓ HPC 16-39: Complainant alleged that an officer wrote the wrong information on <br />the police report, and that the other driver should have gotten another citation. <br />Commissioner Paiva motioned to refer the complaint to the Police Chief for <br />customer service and procedural concerns as noted in the complaint. <br />Commissioner Gomes seconded, and it carried unanimously. <br />✓HPC 16-41: Complainant alleged that officers used excessive force during his <br />arrest. Vice Chair Morioka motioned that there was insufficient evidence to prove <br />the allegations of misconduct and that the officers' actions were lawful and <br />proper. Commissioner Buckman seconded, and it carried unanimously. <br />✓ HPC 16-42: Complainant alleged that officers broke her screen door and took her <br />children away from her. Commissioner Hendricks motioned that there was <br />insufficient evidence to prove the allegations of misconduct. Commissioner <br />Paiva seconded, and it carried unanimously. <br />✓ HPC 16-43: Complainant alleged that an officer was involved in the seizure of his <br />wife's vehicle, and he wants it returned. Commissioner De Luz motioned that <br />there was insufficient evidence to prove the allegations of misconduct. Vice <br />Chair Morioka seconded, and it carried unanimously. It was noted that the <br />vehicle was returned to the complainant. <br />
