§ 18-33 H AWAI‘I C OUNTY C ODE <br />(c) Certificates to operate taxicabs are transferable with the prior approval of the <br />commission. An application must be submitted for approval to the commission by <br />the proposed new owners in accordance with the requirements of section 18-32 in <br />the same manner as an application for a new taxicab. The commission shall hold a <br />hearing on the proposed change of owner in the same manner as for a new <br />application, except that if the service is to be provided under the same terms and <br />conditions as provided in the original certificate, the service will be assumed to be <br />justified by public convenience and necessity. Upon the approval of a transfer of <br />ownership, the new certificate holder will have thirty days to comply with the <br />requirements of this chapter regarding taxicabs and obtain a taxicab license in the <br />certificate holder’s name for the current year. <br />(d) A successful applicant for a certificate who fails to obtain a taxicab license for the <br />current year within thirty days after the certificate is granted shall be subject to <br />revocation proceedings by the commission under section 18-8 of this chapter. <br />(e) An applicant whose application for a certificate is denied by the commission shall <br />receive in writing a statement detailing the reasons for denial of the application. An <br />appeal of the decision of the commission may be made to the circuit court of the <br />third circuit in accordance with section 18-13 of this chapter. <br />(1990, ord 90-119, sec 6.)18-33 <br />Section 18-34. Personal use by driver. <br />(a) Whenever a taxicab equipped with a taximeter is in personal use of the driver and <br />not for hire, a “special” sign shall be affixed to the flag of the taximeter. <br />(b) The director of finance shall prescribe the size and specification of the “special” <br />metal sign and the sign shall be furnished by the director at cost. <br />(1983 CC, c 18, art 2, sec 18-34; am 2008, ord 08-107, sec 5.)18-34 <br />Section 18-35. Cruising. <br />(a) Except in those areas controlled by the Federal or State government or its agencies <br />where cruising is prohibited by statute, rule, regulation, directive, or order, a driver <br />of a taxicab shall be permitted to cruise in search of patronage at anytime. <br />(b) This section shall not apply to any taxicab driver soliciting patronage at any <br />steamship wharf or airplane terminal. <br />(1983 CC, c 18, art 2, sec 18-35.)18-35 <br />Section 18-36. Unauthorized possession of taxicab paraphernalia. <br />No person who does not possess a valid taxicab license issued pursuant to the <br />provisions of this article shall permit any motor vehicle owned, operated or otherwise <br />under the control of such person to be equipped with, carry or display any: <br />(a) Taximeter; <br />(b) Fare box; <br />(c) Taxicab driver’s permits; or <br />(d) Any sign, light, or other device that identifies such motor vehicle as a taxicab. <br />(1983 CC, c 18, art 2, sec 18-36; am 1990, ord 90-19, sec 6.)18-36 <br />18-12 <br /> <br />
