§ 18-45 H AWAI‘I C OUNTY C ODE <br />(b) When a taximeter designed to calculate fares upon the basis of a combination of <br />mileage traveled and time elapsed is operative with respect to fare indication, the <br />fare-indicating mechanism shall be actuated by the mileage mechanism whenever <br />the vehicle is in motion at such a speed that the rate of mileage revenue equals or <br />exceeds the time rate, as determined by the division of measurement standards of <br />the State department of agriculture, and may be actuated by the time mechanism <br />whenever the vehicle speed is less than this and when the vehicle is not in motion. <br />(c) Means shall be provided for the vehicle operator to render the time mechanism <br />either operative or inoperative with respect to the fare-indicating mechanism. <br />(d) The flag or other convenient and effective means of the taximeter shall be kept in <br />the appropriate employed position until the termination of the trip. At the <br />termination of the trip, it shall be the duty of the driver to throw the flag or other <br />convenient and effective means of such taximeter into the nonemployed position. <br />(e) This section shall not apply when a taxicab is being operated as a shared-ride taxi <br />under a County-sponsored public transit program. <br />18-45 <br />(1983 CC, c 18, art 2, sec 18-45; am 1979, ord 501, sec 1; am 1990, ord 90-37, sec 3.) <br />Section 18-46. Registration and inspection required. <br />(a) No driver or owner of a taxicab shall offer or let the taxicab for hire unless the <br />taximeter installed therein or adjusted for any change in mileage rate is first <br />registered with and inspected by the State division of measurements standards and <br />found to calculate and register fares correctly in conformity with the rates as set <br />forth in this article and a seal attesting thereto is placed on the taximeter. <br />(b) It shall be the duty of the owner or driver of any taxicab equipped with a taximeter <br />to submit the taxicab to the State division of measurements standards for <br />inspection, testing, and sealing on the date established by the division. Every <br />inspection shall include the examination and inspection of the taximeter affixed in <br />the taxicab, every wheel, tire, gear shaft, and every part of the taxicab which may <br />affect or control the operation of the taximeter. <br />(1983 CC, c 18, art 2, sec 18-46.)18-46 <br />Section 18-47.
