§ 18-6 H AWAI‘I C OUNTY C ODE <br />(c) The commission, after hearing, may suspend, alter, amend, or revoke any <br />certificate issued, or may issue a temporary certificate. Every carrier shall operate <br />and furnish service in strict conformity with the terms and provisions of the <br />carrier’s certificate, except in cases of emergency defined by the commission. <br />(1983 CC, c 18, art 1, sec 18-6; am 1979, ord 464, sec 2; am 1990, ord 90-119, sec 2.)18-6 <br />Section 18-7. Issuance in two or more names. <br />Any certificate issued in the names of two or more persons shall be presumed to be <br />owned in joint tenancy, unless otherwise specifically stated by a written form submitted <br />to the commission. <br />(1983 CC, c 18, art 1, sec 18-7.)18-7 <br />Section 18-8. Revocation; causes. <br />Any certificate of a carrier issued under this division may be suspended or revoked <br />only for any of the following causes: <br />(1) The failure of the carrier to comply with the terms and conditions of its <br />certificate. <br />(2) The discontinuance by the carrier of the business of transporting passengers <br />as a common carrier of passengers operating upon and using the public <br />highways for a period of thirty consecutive days or more; provided that this <br />paragraph shall not prevent the commission from altering or amending any <br />certificate by reducing the service required thereunder when the <br />discontinuance of the business relates only to one or more but less than all of <br />the vehicles operated by the carrier. <br />(3) The conviction of any driver of a vehicle operated by a certificated carrier of <br />the charge of driving while intoxicated or under the influence of intoxicating <br />liquor or of violating chapter 329 or chapter 281, Hawai‘i Revised Statutes. <br />(4) The wilful refusal of the owner of a bus to pay for use of parking area in the <br />bus terminal as provided in division 5 of this article. <br />(5) The failure of the carrier to comply with this division and any lawful order of <br />the commission. <br />(1983 CC, c 18, art 1, sec 18-8.)18-8 <br />Section 18-9. Rates, routes, safety standards, and insurance set by <br />commission. <br />(a) The commission by order shall fix, prescribe, and establish routes, schedules, rates, <br />standards of safety, and insurance requirements as set forth in this section. All <br />these matters shall be determined as to each carrier upon the hearing in connection <br />with the original application for certificate of convenience and necessity, and <br />thereafter, after a hearing upon application, complaint, or the commission’s own <br />motion, may be changed, amended or altered. <br />18-4 <br /> <br />
