Mr. Goodenow: Right. <br />Mr. Adams: To me....Right. So if our order ... because the way we've been <br />doing the order I mean we just go back and take a look at it. We <br />are finding no conflict for petitioner if the bid is with a specific <br />department and as long as that is where the bid is going on the next <br />time without a specific bid number being in there than that's to me <br />there shouldn't be an issue with purchasing receiving that and that <br />being in accordance with the law as it's written. That's how we've <br />approached the statute or the ordinance so far. <br />Mr. Goodenow: I agree. <br />Mr. Robinson: I just ... if I could. One thing I heard from Ms. O'Dell that <br />concerns me is ... is that purchasing considers this to bid specific -or <br />each time somebody has a bid they have to come back here. <br />Mr. Adams: That's what I heard as well. Maybe it's this one time. <br />Ms. O'Dell: No ... because the bid was mentioned within the document itself <br />they thought it was bid specific. <br />Mr. Robinson: Oh I see ... that's just the findings of fact. <br />Mr. Goodenow: Findings of fact right. <br />Ms. O'Dell: It was basically this one because the next one you did for Parks & <br />Recreation you kind of just blanked it in the findings and <br />conclusions where you just said the Department of Parks & <br />Recreation. <br />Mr. Goodenow: I see. <br />Ms. O'Dell: So I think that one was a little bit better. <br />Mr. Robinson: So it's important like Mr. Adams point is that we don't make it to <br />specific so. <br />Mr. Adams: At least in the conclusion of law I think that we have in these <br />situations decided that at the department level we can be as broad <br />as the department level and not require a bid by bid need for us to <br />review these things and then of course this is a work in progress so <br />the next time you put something into the Department of Public <br />Works for your husband then I guess we'll see whether or not they <br />accept it or not. <br />16 <br />
