Hawaii Police Commission <br />Regular Session Minutes <br />February 17, 2017 <br />Page 3 <br />Ways and Means Committees expressing the commission's position against the <br />bills. Commissioner Carlson asked that she get input from the Administration first <br />and then opine on legal issues and how it would affect the commission. Ms. Ho <br />stated that she will confer with the Mayor. The usual procedure is for Corp Counsel <br />to review or draft correspondence, but it comes from the commission. <br />EXECUTIVE SESSION <br />Commissioner Gomes motioned to meet in executive session to consider discipline and <br />charges against officers or employees of the Hawaii Police Department, to consider <br />sensitive matters relating to public safety, and may consult with Corporation Counsel on <br />questions and issues pertaining to the commission's powers, duties, privileges, <br />immunities, and liabilities pursuant to HRS 92-5 (a) (2) (4) (6) and the Hawaii County <br />Charter Section 13-20 (b). Commissioner Schutte seconded, and it carried <br />unanimously. Executive session convened at 10:12 a.m. <br />Regular session reconvened at 12:45 p.m. <br />ACTION ON EXECUTIVE SESSION MATTERS <br />• Correspondence No. 17-02: Request for legal counsel for former Officer Jody <br />Buddemeyer. Commissioner Schutte motioned to continue this matter to the next <br />meeting. Commissioner Carlson seconded, and it carried unanimously. <br />Consideration and Investigation of Complaints <br />✓ HPC 16-49: Complainant alleged that an unidentified officer drove in excess of <br />70 mph. He also complained about how another officer responded to him <br />when he complained about this. Commissioner Schutte motioned that there <br />was insufficient evidence to prove the complainant's allegations of misconduct. <br />Commissioner Gomes seconded, and it carried unanimously. <br />✓ HPC 16-50: Complainant alleged that there were discrepancies in his police <br />reports. The complaint was received more than two years from the date of the <br />incident. Commissioner Schutte motioned to decline investigation of the <br />complaint due to the 90 -day rule. Commissioner Carlson seconded, and it <br />carried unanimously. <br />✓ HPC 16-51: Complainant alleged that two officers drove in excess of 70 mph. <br />Commissioner Schutte motioned that there was insufficient evidence to prove <br />the allegations of misconduct. Commissioner Buckman seconded, and it <br />carried unanimously. <br />✓ HPC 17-01A & B: Complainant alleged that six unidentified officers used <br />excessive force during his arrest. Commissioner Schutte motioned that there <br />was insufficient evidence to prove the allegations of misconduct. <br />Commissioner Carlson seconded, and it carried unanimously. <br />
