Aquino, Chair <br /> Committee on Transportation <br /> Hawai'i State Capitol <br /> Honolulu, HI 96813 <br /> Dear Chair Aquino and Members: <br /> RE: SB 221 <br /> Relating to Highway Safety <br /> Thank you for this opportunity to testify in support of SB 221, SD2. <br /> As we understand the intent of this bill, it is to give the counties the option of <br /> implementing a photo red light program. Our attorneys have one concern: that the <br /> language of Part III, Section -2 ("There is established the photo red light imaging <br /> detector systems program...") and Section -3 ("Each county may establish and <br /> implement...") might be read to mean that if a county does not exercise its option, <br /> someone else could (perhaps the State, or even some other entity). <br /> If it is made crystal clear that the option is with the county, and only with the <br /> county, we believe this is a good initiative.
