RULES OF GENERAL APPLICABILITY <br />1.1 Authority <br />These rules govern practice and procedure before the Banyan Drive Hawaii <br />Redevelopment Agency of the County ofHawaii under Chapter 53, 91, 92 and 92F, <br />Hawaii Revised Statutes and Article XIII, Hawaii County Charter. <br />1.2 Construction of Rules <br />The rules shall be liberally construed to secure the just, speedy, and inexpensive <br />determination of every proceeding. <br />1.3 Procedure and Terms <br />a. Statutory Terms. The terms used in rules promulgated by the Agency pursuant to <br />powers granted by statute shall have the meaning defined by such statute, unless <br />the context otherwise specifically requires. <br />b. Ten -ns Defined by Rule. A rule or regulation that defines a term without express <br />reference to the statute or to these rules or to a portion thereof, defines such terms <br />for all purposes as used both in the statute and in these rules, unless the context <br />otherwise specifically requires. <br />c. Use of Number .importing the singular number may extend and be applied to <br />several persons or things; words importing the plural may include the singular. <br />1.4 Definitions <br />a. Agency. The term "Agency" means the Banyan Drive Hawaii Redevelopment <br />Agency. <br />b. Chairperson. The term "Chairperson" means the Chairperson of the Banyan Drive <br />Hawal.`i Redevelopment Agency. <br />c. Contested Case. The Term "Contested Case" means a proceeding in which the <br />legal rights, duties, or privileges of specific parties are required by law to be <br />determined after an opportunity for agency hearing. <br />4 <br />
