Kelly <br /> Secretary <br /> Department of Homeland Security <br /> Washington, DC 20528 <br /> Dear Secretary Kelly: <br /> Along with our Hawai'i Congressional leaders, Sen. Mazie Hirono, Sen. Brian Schatz, <br /> Rep. Tutsi Gabbard and Rep. Colleen Hanabusa, I am writing in support of Mr. Andres <br /> Magana Ortiz of Kailua-Kona, Hawai'i in his request for a stay of his removal from the <br /> United States. Mr. Andres Magana Ortiz has received a Final Order of Removal and <br /> has been ordered to report to US ICE in Honolulu for deportation on June 8, 2017. <br /> We ask at this critical time that your Department exercise the use of its prosecutorial <br /> discretion to allow Mr. Magana Ortiz remain in the United States and obtain Legal <br /> Permanent Resident status, based on his US citizen spouse's 1-130 Relative Petition. <br /> His wife's application is pending and currently being adjudicated by your Department. <br /> Mr. Magana Ortiz's case warrants your favorable exercise of prosecutorial discretion as <br /> it is not considered a high priority for enforcement based on the following reasons: <br /> 1) he has had a long-term presence in the US, having been here over 28 years <br /> when he arrived as a teenager. He is an upstanding member of our community; <br /> 2) he has immediate family members who are all US citizens: his wife and 3 minor <br /> children ages, 12, 14 and 20; and <br /> 3) he has established compelling ties and made compelling contributions to the <br /> Unites States as a successful coffee farmer and businessman in his community. <br /> Mr. Magana Ortiz is not a threat to our national security or public safety. His US citizen <br /> spouse and 3 minor children all depend on him especially during this time in their lives. <br /> His coffee farm is thriving and will need to be harvested in a few months. Removing <br /> him from the United States would be devastating and undoubtedly cause extreme <br /> hardship to his family, his Kona coffee business, and his community. <br /> County of Hawaii is an Equal Opportunity Provider and Employer. <br />
