first public hearing at the Planning Commission. Contested case proceedings are, are different. <br />This is just referring to your first Planning Commission hearing. And the reason for the rule, <br />obviously, is so that the Department doesn’t just let an application linger for months and months <br />and months; we’re required to take it to hearing so that the Commission can consider it in a <br />timely manner. <br /> <br />CLARKSON: Well, then, I would suggest substituting the word, “initiate” for “conduct” or <br />“start.” <br /> <br />JACKSON: Okay. How about, “The Commission shall conduct its first public hearing within a <br />period of 90 days?” Would that, would that work? Because I think it’s important we say <br />“conduct”; it’s actually held. “The Commission shall conduct its first public hearing?” <br /> <br />CLARKSON: That’s fine. <br /> <br />JACKSON: Okay. <br /> <br />CARR SMITH: Isn’t that what it says? <br /> <br />JACKSON: It just says “a public hearing.” <br /> <br />CARR SMITH: Just adding the word, “first?” <br /> <br />JACKSON: Yeah. Yeah, actually Jeff just pointed out to me that your rules are a little different <br />with the language. So if you look at Page 7-3, Section 7-5, this is for Use Permits, so Page 7-3, <br />Section 7-5, under Public Hearings, this one says, “Upon acceptance of a use permit application, <br />the Commission, through the Department, shall fix a date for the public hearing. The public <br />hearing shall commence no later than ninety days after the acceptance of a use permit application <br />by the Director, or within a longer time period as agreed to by the applicant.” And, if you like <br />that language more, we can just apply it to all of the permits. <br /> <br />CLARKSON: I do.
