Community Development Plan (CDP) submitted by the Ka`u CDP Steering Committee and <br />the Planning Director and consider its recommendation to the County Council. <br />The Commission took this item up at 9:39 a.m. with 8 people from the public in attendance. <br />(SEE EXHIBIT C) <br />This item ended at 10:32 a.m. <br />MINUTES — The Commission took this item up at 10:32 a.m. <br />Approval of Minutes of the May 4, 2017 (Windward Planning Commission Meeting,) and <br />May 10, 2017 (Windward Planning Commission Special Meeting) — It was moved by <br />Commissioner Miyasato, and seconded by Commissioner Clarkson, that the Minutes of May 4, <br />2017 and May 10, 2017 be approved as circulated. Motion was unanimously carried by a voice <br />vote of all Commissioners in attendance. <br />Chair Henkel called a recess at 10:33 a.m., and the meeting was reconvened at 10:41 a.m. <br />ADMINISTRATIVE MATTERS - The Commission took up the following at 10:41 a.m. <br />Training relating to the new Planning Commission Rule 16: Planned Unit Developments (PUD) <br />and new Planning Commission permit applications for PUD's. <br />Mr. Kay provided training to the Commission regarding newly adopted Planning Commission <br />Rule 16 pertaining to PUD's and the new proposed Planning Department applications form. <br />Attachments: Exhibit "I " - Proposed Application for Planning Department Permit Form; Exhibit <br />"2" — Sample PUD, PUD 15-029; Exhibit "3" PowerPoint Presentation by Mr. Kay. <br />Upon inquiry by Commissioner Miyasato, Mr. Kay confirmed that the main reason for a PUD <br />was to allow more flexibility (through a set of variances or exceptions) against the requirements <br />of the Subdivision and Zoning Codes to meet a certain design concept. Mr. Kay added that the <br />shifting of the PUD's to the Commission gave the public a greater voice in the process. He <br />stated that a condition of approval in terms of exceptions [to the Subdivision and Zoning Codes] <br />in some past PUD's was the submittal of a master plan, and that this practice would continue. <br />Upon inquiry by Commissioner Miyasato, Mr. Darrow stated that the PUD's were bound to <br />affordable housing obligations and impact fees only if an applicant needed to first submit a <br />change of zone application. <br />Mr. Darrow informed Commissioner Miyasato and Commissioner Clarkson that Ms. Self was <br />referencing the Missler case during her previous discussion [in Item No. 4], which concerned a <br />PUD and the Kona CDP.
