RULE 1. GENERAL RULES <br /> 1-1 Title <br /> These rules and regulations shall be known as the"Rules of Practice and <br /> Procedure for the Hawai`i County Cultural Resources Commission." <br /> 1-2 Authority <br /> The rules herein are established pursuant to the provisions of Chapter 2,Article <br /> 44 of the Hawai`i County Code and Chapter 91-1 of the Hawaii Revised Statutes. <br /> 1-3 Purpose <br /> These rules and regulations govern practice before and procedures of the Hawai`i <br /> County Cultural Resources Commission and set forth general rules applicable to <br /> proceedings before the Commission. <br /> 1-4 General Definitions <br /> (a) "Agency"means any agency,board, commission, department, or officer <br /> of the county or state government. <br /> (b) "Applicant"means any agency or person who applies to the Commission <br /> for an opinion, recommendation, or determination. <br /> (c) "Commission"means the Hawai`i County Cultural Resources <br /> Commission. <br /> (d) "Council"means the Hawaii County Council. <br /> (e) "County"means the County of Hawai`i, a political subdivision of the State <br /> of Hawaii. <br /> (f) "Culture"means the traditions,beliefs,practices, lifeways, arts, crafts, and <br /> social institutions of any community,be it an Indian tribe, a local ethnic <br /> group, or the people of the nation as a whole. <br /> (g) "Department"means the Hawai`i County Planning Department. <br /> (h) "Director"means the Director of the Hawai`i County Planning <br /> Department. <br /> (i) "Government Record"means information maintained by an agency in <br /> written, auditory,visual, electronic, or other physical form. <br /> 0) "Hawai`i Register"means the Hawai`i Register of Historic Places, which <br /> is a state register of historic properties,maintained by the Hawai`i Historic <br /> Places Review Board. <br /> 1 <br />
