Ms. Kahakalau: I called for a motion multiple times on Petition No. 2017-07 and <br /> we've had all kinds of ideas on the table but not a real motion and <br /> certainly not a second to discuss it any further. <br /> Mr. Murai: Why don't we do this then...in light of board member Adams' <br /> concern...Madame Chair I suggest you call the two matters by <br /> petition number and invite the respondents to the table and we can <br /> note for the record that Mr. Hyland the petitioner is not present. <br /> Ms. Kahakalau: That I would entertain that in the absence of nobody else making a <br /> motion but I still feel uncomfortable without a motion on the table. <br /> Mr. Adams: I think what Counsel is saying Madame Chair if I may...is that you <br /> have the ability to call the respondents to the table when you call <br /> forward the petition to the attention of the board...then you can <br /> then call for the petitioner to testify noting that there is no <br /> petitioner...you can then call for the respondents to testify. <br /> Ms. Kahakalau: And then... <br /> Mr. Adams: That's part of the normal rules where we would operate and then <br /> we can have questions if we decide to...we can make a motion that <br /> point if we decide to...the fact that you're calling the <br /> petition...that means that we've now accepted the petition for <br /> consideration. <br /> Ms. Kahakalau: Okay. Well I believe that the very beginning of the meeting when <br /> checked if Mr. Hyland was in Kohala...I also asked if...if anybody <br /> is here that would like to speak to this petition and there was <br /> nobody responded. <br /> Mr. Adams: As a petitioner. <br /> Mr. Robinson: Or respondent. <br /> Ms. Kahakalau: Or respondent... I thought I said if there's anybody here that <br /> would like to respond to the petition and I can ask that question <br /> again...is there anybody here that would like to respond to the <br /> petition...but it doesn't seem like... <br /> Mr. Adams: It doesn't seem like it either. <br /> Ms. Kahakalau: Okay...so we don't have a petitioner that's here and we don't have <br /> anybody that from the audience that would like to respond at this <br /> point to the petition so we have a number of options...one is to <br /> obviously the rejection part and one is a continuation part. <br /> 8 <br />
