• <br />• <br />• <br />and received by the Engineer after the deadline above will also <br />be denied. <br />An addendum shall -be issued to the specification to formally <br />inform the prospective bidders of approved substitution of brand <br />or brands which are equivalent to those specified and acceptable <br />for use on the proposed project. <br />This addendum shall be mailed to prospective bidders five (5) <br />days before the opening date of bids, not including the date of <br />bid opening. <br />(b) A fter,Bid Onening - Substitution of material or equipment will <br />not be allowed after the bid date except when dictated by the <br />following unforseen circumstances: <br />1. If a specified or prequalified item is delayed by a lengthy <br />strike in the factory or other unforseeable contingency <br />beyond the control of the Contractor which would cause an <br />abnormal delay in the project completion, a substitution <br />will be considered. <br />2. If a specified or prequalified item is found to be unusable <br />due to change or other cirsumstances, a substitution will be <br />considered. <br />If the Contractor is willing to provide a more recently <br />developed or manufactured model of material or equipment <br />of the same name manufacturer which the Engineer determines <br />to be equal or better than the one specified or prequalified, <br />a substitution will be considered. <br />A substitution request, regardless of reason, shall be fully explained <br />in writing, by the Contractor including his justification for said request, <br />quantities and unit prices involved, quotations and such other documents as are <br />deemed necessary to support the request. Any savings in cost will be rebated <br />to the County and any additional cost for the substituted items will be paid for <br />by the Contractor. <br />The above shall not be construed to mean that substitutions for brand <br />name specified materials and equipment will be allowed; the Engineer reserves <br />the right to reject and deny any request he deems irregular or not in the <br />best interest of the County. <br />6.3 SOURCE OF SUPPLY OF MATERIALS - At the option of the Engineer, the <br />source of supply of each of the materials may be approved by the Engineer <br />before delivery is started. Representative preliminary samples of the character <br />and quantity prescribed shall be submitted by the Contractor or producer for <br />examination and tested in accordance with the methods referred to under samples <br />and tests. <br />Section 6 <br />Page 27 <br />
