Community Actions — Community led initiatives with support from range of agencies and organizations. 15 land Use Policies Policy Intent General statements that express policy aims, goals, or objectives. Refine language to provide clarifications in policy intent and implementation. More specifically the recommendations changed "shall" to "should" in Policy 8 and Policy 22 to provide clarity on appropriate use of mandates. (HRS 205-5(b); (GP 14.2.3(s)). Revision Rationale: Removed the "shall" due to it inferring a legal mandate that was followed by the less enforceable intent to "encourage' and "endeavor. " 25 Planning Director Recommendations 2. Delete 3 policies due to clarifications in State law or changes to State law including: • Prohibiting Cesspools in SMA (State essentially banned' cesspools in all areas during CDP development); • Developing Clustered Rural Subdivisions (State minimum lot sizes preclude this strategy); and • Allowing farmers' markets or roadside stands on ag land � (Changes to State code now allow as permitted uses). I 26 Planning Director Recommendations 3. Add a New Policy 39 directing future amendments to zoning code to develop a cliff setback. Note: This policy does not prescribe what the cliff setback will be and requires future action to amend the zoning code.
