As I mentioned before, I recently joined Hu Honua, but we have a project team here who will be <br />able to assist in any questions that the Windward Planning Commission may have. Mahalo for <br />your time and consideration. Thank you. <br />CLARKSON: Thank you. Do you, does your group have any further statement to make at this <br />time? <br />LEE: Chairman Clarkson, that is our statement at this time. <br />CLARKSON: That is your statement. Are there any questions from the Commission? I have a <br />question. So, you would not object to an additional finding of fact and an additional condition <br />that would indicate that you will not be repairing or replacing the Outfall and that as a finding of <br />fact, and a condition that you shall not repair or replace the Outfall. You would agree with that <br />kind of a. <br />YAMAMOTO, W.: This is Wil Yamamoto, counsel for Hu Honua. Yes, we would agree to <br />that. I believe the specific language that we're proposing is in the draft second supplemental <br />decision and order attached to our February 27 letter. <br />CLARKSON: Thank you. Thank you, please be seated, and we can start with the public <br />testimony of which there appears to be a great deal. The, let's do this by—okay, we're going to <br />call six people at a time. I'm going to swear you all in, and then we're just going to pass the <br />microphones down. Everyone will have three minutes to make their presentation. The first six <br />people are, and forgive me if I mispronounce or misread how to pronounce your names, Max <br />Newberg, Koohan Paik, Lisa Andrews, Colleen Lawrence, Christopher Dean, and Robert Smith. <br />Would you please come forward and be seated at the table in front of the Commission? <br />PAIK: I think Colleen Lawrence left. <br />CLARKSON: Okay, so then the next person on the list would be Gino Guss. Gino Guss, please <br />come forward. Some of you have already been sworn in. For those who haven't, please raise <br />your right hands. There you go. Do you swear or affirm to tell the truth on this matter before the <br />Planning Commission today? <br />TESTIFIERS: I do. <br />CLARKSON: Thank you. <br />NEWBERG: I do. <br />CLARKSON: Okay. We'll start with Koohan and then proceed down. Please proceed. Now, <br />remember, the item on the agenda is what the impact of the repair or the replacement of Outfall <br />001 will be and apparently, there will be no repair or replacement, so I don't know what you're <br />going to talk about, but please proceed. <br />EXHIBIT C <br />11 <br />
