ARTICLE I <br />INCORPORATION AND GEOGRAPHICAL LIMITS <br />Section 1 -1. Incorporation. <br />The people of the county of Hawaii shall be and continue as a body politic and corporate <br />by the name of "County of Hawai`i," hereinafter in this charter called "county." By that name it <br />shall have perpetual succession. <br />(2010, Prop. 7, sec. 2.) <br />Section 1 -2. Geographical Limits. <br />The island of Hawaii and all other islands within the shores thereof and the waters <br />adjacent thereto shall be the county of Hawaii. <br />(2010, Prop. 7, sec. 2.) <br />ARTICLE II <br />POWERS OF THE COUNTY <br />Section 2 -1. Powers of the County. <br />The county shall have all powers possible under the constitution and laws of the State of <br />Hawaii, including all powers now or hereafter given by such constitution or laws, and all other <br />powers not prohibited by such constitution or by this charter. The county shall have such powers <br />as fully and completely as though specifically enumerated in this charter, and no enumeration of <br />powers in this charter shall be deemed exclusive or restrictive. <br />(2010, Prop. 7, sec. 3.) <br />Section 2 -2. Exercise of Powers. <br />All powers of the county shall be carried into execution as provided by this charter or, if <br />the charter makes no provision, by ordinance or resolution of the county council. <br />ARTICLE III <br />LEGISLATIVE BRANCH <br />COUNTY COUNCIL <br />Section 3 -1. Powers and Functions. <br />The legislative powers of the county shall be vested in the county council. Its primary <br />function shall be legislation and public policy formulation, as distinct and separate from the <br />executive administration of county government. <br />Section 3 -2. Composition and Terms. <br />There shall be a county council composed of nine members. One member shall be <br />elected from each of nine districts. The terms of the council members shall be two years and <br />shall begin at twelve o'clock meridian on the first Monday of December after their election. The <br />terms of the council members shall not exceed four consecutive two year terms. Candidates shall <br />be elected in accordance with the election laws of the state, insofar as applicable. <br />(1990, Prop. 1, sec. 1; 1996, Ord.
