Is <br />that what the intent is? <br />IRVINE: Protection and public safety, or whatever you say, yes. <br />HERKES: Perform public safety - <br />IRVINE: Obviously, there’d have to be a few changes but - <br />HIGASHI: So, why don’t you come up with a draft rather than adopting this thing, as a whole? <br />HERKES: Okay. <br />RAY: Somebody needs to look into City and County, because I’m looking at that and I can’t figure out - I mean, they have a <br />page and a half on the Fire Department and one paragraph on the Police Department, so I don’t know where the rest of this <br />stuff is. <br />IRVINE: Is that page 14, 15? In the ‘96 supplement, I think there’s more. But, you’re probably right, that maybe we need to <br />have Chris write this up as it might apply to our Police Commission, find out about General Orders, or whatever those are. <br />HIGASHI: If it’s covered under the General Orders like training. <br />IRVINE: Who knows about General Orders? Who would we ask? <br />RAY: I don’t think we have enough information to make any decision on this. We do have a meeting next Wednesday so if, <br />just in the meantime, maybe Marni, you could do a little more research. <br />HERKES: I’ll rewrite it. There are five members on this commission rather than nine. Did we have any discussion on that? <br />RAY: No, we didn’t. <br />HERKES: Okay. <br />RAY: But, that’s a good point you brought up so that’s something we need to deal with on the Fire Commission, right? <br />YUEN: Well, it got adopted as written up with five, right? So if you want to change it, you’ve got to decide what you want to <br />do. <br />HERKES: I like the five, but I’m open. <br />YUEN: There are two different kinds of things that are being talked about with the Police Commission. One is a, kind of, <br />general statement about what the Police Department is supposed to do, which is not really in our Charter. You could say <br />duties of the Chief of Police; arrest lawbreakers, prevent crime, that sort of thing. That’s a general statement. Then, there was <br />a motion by Marni which was, I thought, to adopt as the powers of the Police Commission, something similar to 6-4.2, <br />similar to what we had put in on the Fire Commission. Let me just describe what is significantly different between the powers <br />of the Fire Commission and the powers of the Police Commission under the present Hawaii County Charter. First, I think, <br />and I’m looking at the Fire Commission, not the Police Commission: (a) is already in there; (b) is already in there; <br />BESS: And the Council. <br />YUEN: Okay, to the Mayor and the Council. It’s basically similar. (c) is review the department’s operations. That is not in <br />there for the Police Commission, so that’s different; (d) annual evaluation, is not in there for the Police Commission <br />presently; (e) review personnel actions for conformance with policies, is not in there for the Police Commission presently; (f) <br />complaints of citizens, is in there for the Police Commission with different wording and, actually, a little broader because <br />file://\\coh01\cohweb\council\charter_commission\minutes\minutes 02-05-00.html7/1/2011 <br /> <br />
