I just thought I’d mention that. <br />PAKELE: I’ll correct that. The Statute says five members, no less than five members. <br />YUEN: Right, no less than five. I’m sorry. <br />RAY: Number D, dealing with the Code of Ethics. Marni, you want to – <br />HERKES: Yes. And I passed this out before and it’s in the Maui Charter under the Code of Ethics; ‘Elected and appointed <br />officers and employees shall demonstrate by their example the highest standards of ethical conduct to the end that the public <br />may justifiably have trust and confidence in the integrity of government.’ <br />RAY: Want to read it again? <br />HERKES: ‘Elected and appointed officers and employees shall demonstrate by their example the highest standard of ethical <br />conduct to the end that the public may justifiably have trust and confidence in the integrity of government.’ That’s in the <br />minutes from the Volcano meeting and it’s also passed out to you. <br />RAY: Right, yes. We’ve had that in writing. <br />IRVINE: Can I ask one thing? On the written copy of this, it says replace Section 14-1 with this. <br />HERKES: Where is 14-1? <br />IRVINE: Page 32, bottom of the page. Section 14-1 is Enactment which says the Council shall adopt by ordinance a code of <br />ethics, etc., and I think we’d have to – <br />HERKES: Oh, I think it’s, yes – We want not to replace it. <br />IRVINE: No, you don’t want to. You want to add it or something. <br />HERKES: I want to add it. <br />BESS: I have a question. <br />HERKES: Yes. <br />BESS: Is ‘by their example’ important to you? I’m wondering whether ‘shall demonstrate the highest standards of ethical <br />conduct’ – what does ‘by their example’ add to it? <br />HERKES: It means by their actions, the way they act. <br />BESS: But, if we’re demonstrating, aren’t we demonstrating through our actions and words and otherwise? <br />HERKES: Can I ask you what the problem is? <br />BESS: No, I’m just saying is it necessary because ‘by their example’ – you know, I think what we’re doing is – there may <br />even be a limitation. If we’re limiting to just actions, it’s fine. But demonstration would include actions and words as well. <br />IRVINE: Right. And we don’t want it to be just actions. <br />HERKES: Okay.
