TAKAHASHI: No, I prepared those comments just for your information. It's just to <br />show this body some of the inconsistencies I observe in the Charter. Now, I'm not <br />saying we have a real problem. Much of them are potential problems. So, if you have <br />any questions. <br />RAY: So, we have all that in writing. I think it's pretty well explained. I <br />think we were hoping to solicit a little stronger opinion, one way or the other, but <br />apparently, we're not going to get that. <br />IRVINE: I did have, maybe, a question to help clarify. I know, in Section <br />13-13, contracts will be signed by the Mayor except as otherwise provided. I think <br />our attorney on the Board here, Steve Bess, had said that we could, maybe, change <br />that by ordinance because they say "except as otherwise provided". Maybe this is a <br />question for our attorney. Should we make anything under $25,000 or, I hate to put <br />numbers in the Charter particularly, but do you have a suggestion as how to implement <br />that, if we do happen to change it, or how to state it? <br />TAKAHASHI: Yes, probably the Mayor would be willing to pass off on some of <br />the lesser contracts because it's an awful lot of contracts that needs to be submitted to <br />him for signature. But it would probably be a "may" situation, not a "shall" situation <br />because there may be contracts that he may insist that he review, no matter what the <br />price tag. <br />IRVINE: <br />RAY: <br />Okay. <br />John, do you have a question? <br />SANTANGELO: Just for a point of information, having been involved in that a little <br />bit, maybe you can help us understand. In your opinion, how many contracts the Mayor <br />doesn't sign? <br />TAKAHASHI: I believe, right now, it's just a handful. <br />SANTANGELO: Very, very small amount. <br />TAKAHASHI: And usually there's another provision for him, not signing it, <br />because I think the Council signs the external audit contract. I know there are <br />instances where I sign on some of the agreements where they're provided by different <br />laws. <br />SANTANGELO: But basically, the way the Charter's written right now, the Mayor is <br />the one responsible for all contracts. <br />
