MS. CRAWFORD: I missed the very beginning, and I just want to make sure that you <br />still said, "at a minimum," or is it just "three times a year." <br />CHR. HAITSUKA: Ms. Kawauchi, can you repeat your motion again? <br />MS. KAWAUCHI: Sure. The motion would be to subsection (a). It would delete the last <br />sentence of subsection (a), which is underscored in our present draft, in its entirety and the <br />motion replaces that language with the following: "Deposits to the fund will occur three <br />times a year, and no later than (1) 45 days after the majority of taxes have been collected <br />and, (2) with the final payment at the end of the fiscal year." <br />CHR. HAITSUKA: Ms. Crawford, do you have any comment on that motion? <br />MS. CRAWFORD: My only comment is that you are specifying three transfers per year <br />period. I can certainly live with that if that's what you want. <br />CHR. HAITSUKA: Currently, how often are these transfers made; how many times a <br />year? I know it's not being made now, but when they were being made. <br />MS. CRAWFORD: You know, I can't say for sure, but I can tell you there have been at <br />least three per year. I'm not sure if there were additional ones at any certain times. But, <br />when we get around to year -end, I think the way you have written it, fiscal year -end, gives <br />us the flexibility to actually make the deposits at the appropriate time. <br />MS. OSBORNE: Mr. Chairman, I'm just wondering if the language is clear enough that <br />the first two payments happen after the taxes have been collected. Is the language clear <br />enough? <br />MS. KAWAUCHI: I think so. <br />MS. JARMAN: I had the same question. Couldn't that be interpreted to mean that 45 <br />days after the second set of taxes has been collected, which would be 45 days after <br />September? Wouldn't the majority of taxes have been collected in September? <br />MS. CRAWFORD: If you lock us into technicalities, yes, the September collection is <br />usually larger. August payments are usually larger than the February total receipts. But <br />that is not our intention. When we talk about the majority of taxes being collected, we <br />know we collect two times a year, and that's our intention to make the transfer as soon as <br />we have the money. But, yes, it could certainly be interpreted that we only pay once then <br />and two times in June, I suppose. <br />MS. JARMAN: That's how it reads to me. <br />CHR. HAITSUKA: Ms. Crawford, how about if we used assessments instead of <br />collection? Real property taxes are assessed twice a year, in February and August, right? <br />15 <br />
