Ms. Osborne moved to adopt the non - substantive <br />format corrections to CA -16 Draft 2 as outlined in <br />Comm. 247, from Commission attorney Levi Hookano, <br />dated March 10, 2010. Seconded by Mr. Kealoha and <br />carried by the following vote: <br />Ayes: Commissioners Honma, Jarman, <br />Kealoha, Nahale -a, Osborne, <br />Shumway and Chair Haitsuka. <br />Noes: None. <br />Absent: Commissioners Fuertes, Kaulukukui, <br />Kawauchi and Unger. <br />CHR. HAITSUKA: The second communication we got from the Commission's attorney <br />is a little bit more extensive. <br />COMM. 246: <br />From Commission Attorney, Levi Hookano, dated March 10, 2010, transmitting several <br />legal issues with CA -16 (Draft 2) which must be corrected. <br />CHR. HAITSUKA: I'm going to go over it point by point. The first concern involved a <br />conflict in the language of Section 15 -2, the definition section; particularly the definition <br />for Ballot Summary. In effect, the Commission's attorney is recommending that we <br />delete a portion of the definition of Ballot Summary as it relates to the language, "...and <br />its major effects." That language could be considered confusing and conflicting with <br />language in that definition relating to an "impartial explanation." So the recommendation <br />is to delete the last portion of the definition of Ballot Summary starting with "and" and <br />ending with "effects." So it would be deleting that portion of that definition which states, <br />... and its major effects." <br />Mr. Nahale -a moved to delete the language, <br />11 <br />... and its major effects," from the definition <br />of "Ballot Summary" in Section 15 -2. Seconded <br />Ms. Osborne and carried by the following vote: <br />Ayes: Commissioners Honma, Jarman, <br />Kealoha, Nahale -a, Osborne, <br />Shumway and Chair Haitsuka. <br />Noes: None. <br />Absent: Commissioners Fuertes, Kaulukukui, <br />Kawauchi and Unger. <br />CHR. HAITSUKA: The second concern involves subsection 15 -4 (b)(2). The concern <br />here is that there is a reference to "completed petition," which could be misleading <br />because the petition referenced in that section is actually the petition form prior to it <br />25 <br />
