ARTICLE I <br /> INCORPORATION AND GEOGRAPHICAL LIMITS <br /> Section 1-1. Incorporation.The people of the county of Hawaii shall be and continue <br /> as a body politic and corporate by the name of"County of Hawaii,"hereinafter in this <br /> charter called "county." By that name it shall have perpetual succession. • <br /> Section 1-2.Geographical Limits.The island of Hawaii and all other islands within <br /> the shores thereof and the waters adjacent thereto shall be the county of Hawaii. <br /> ARTICLE II <br /> POWERS OF THE COUNTY <br /> Section 2-L Powers of the County.The county shall have all powers possible under <br /> the constitution and laws of the State of Hawaii, including all powers now or hereafter <br /> given by such constitution or laws, and all other powers not prohibited by such <br /> constitution or by this charter. The county shall have such powers as fully and <br /> completely as though specifically enumerated in this charter, and no enumeration of <br /> powers in this charter shall be deemed exclusive or restrictive. <br /> Section 2-2. Exercise of Powers. All powers of the county shall be carried into <br /> execution asrovided b this charter or, provision,by if the charter makes no rovision ordinance <br /> P Y <br /> or resolution of the county council. <br /> ARTICLE III <br /> LEGISLATIVE BRANCH <br /> COUNTY COUNCIL <br /> Section.3-1. Powers and Functions. The legislative powers of the county shall be <br /> vested in the county council. Its primary function shall be legislation and public policy <br /> formulation, as distinct and separate from the executive administration of county <br /> government. <br /> Section 3-2. Composition and Terms. There shall be a county council composed of <br /> nine members who shall be elected at-large for terms of four years. The terms of <br /> councilmen shall begin at twelve o'clock meridian on the first Monday of December <br /> after their election. Of the nine members elected to the county council, one shall be a <br /> resident of the district of Puna,one a resident of the district of Ka'u,one a resident of the <br /> combined districts of North and South Kona,one a resident of the combined districts of <br /> North and South Kohala,one a resident of the district of Hamakua and one a resident of <br /> the combined districts of North and South Hilo. The person charged with the duty of <br /> conducting elections in the county shall prepare the nomination papers in such a <br /> manner that candidates desiring to file for the office of councilman shall be able to <br /> specify whether they are seeking the seat with a district residence requirement or the <br /> seat with no district residence requirement as the case may be. The ballots for the <br /> primary and general elections shall be prepared to give every voter in the county the <br /> opportunity to vote for each and every council seat.Candidates shall be nominated and <br /> elected in accordance with the election laws of the state. <br /> Section 3-3. Qualifications. A person must be a citizen of the United States of <br /> America and have been a duly qualified elector of the county for at least one year imme- <br /> diately preceding his election or appointment to the county council.Where residency in <br /> a district is a requirement,a person must have been a resident voter of the district from <br /> which he is to be elected or appointed for at least ninety (90) days immediately <br /> preceding the primary election or his appointment. <br /> Section 3-4. Compensation; Salary Commission. <br /> (a) The salary of councilmen shall be established by a salary commission which shall <br /> consist of nine members appointed by the mayor without the approval of the council, <br /> notwithstanding provision (b) in Section 13-4.
