And the budget set up , let ' s say in December, could be <br /> drastically changed by the monies appropriated to the County by <br /> the Legislature , because of there not being funds for those <br /> specific items they wanted the money for. The Legislature is just <br /> about as picky as the Council is in setting up funds for specific <br /> things . <br /> DUNCAN : I understand , Pete , you saying that the County <br /> should go with a common voice. <br /> L'ORANGE : Yeah. That ' s it. <br /> GREENWELL: Well , they do. But the thing is that the <br /> Legislature doesn' t always give monies for the purposes the County <br /> is asking for. And so the change in the budget may be a drastic <br /> one. <br /> L' ORANGE : Oh, I realize that, but when you ' re reviewing <br /> it . . .if you reviewed it together previously , the two-month time <br /> from May 1st to June 30th, you ' ve just gone over the changes <br /> because of what your referring to , you 're not having to review the <br /> whole thing in public hearing in 60 days. <br /> BETHEA: Ron , could you go on with your particular <br /> (inaudible) . <br /> IBARRA : Yes. The other provision that needs to be looked <br /> at is Section 13-13 pertaining to contracts. And. . . <br /> BETHEA : 13-13? <br /> IBARRA : Yeah. It ' s page 28 (tape change, lost some <br /> conversation) the officer of the County to be the (unclear) . I <br /> preface these remarks, as an aside. . .you may have the most <br /> ironclad constitution or charter or contract , but if the players <br /> aren ' t cooperative or follow the document , you ' re always going to <br /> have problems. Whereas if you don' t have a document and you have <br /> honorable players, I 'm not saying the players are not honorable , <br /> but you don' t have to have documents that are ironclad. But , the <br /> contract section that authorizes onlythe <br /> mayor to sign contracts <br /> on behalf of the County comes up in the situation where the <br /> Council may want to hire a consultant and the mayor may not want <br /> to sign that contract. And , so now we have a separation of <br /> powers ' conflict here. And certainly I researched this when I was <br /> corporation counsel , that I' ve always told the department heads <br /> that if the Council demands information, and the purpose of this <br /> is, you know, the contract (inaudible) mayor. <br /> But when the Council demands certain information, that the <br /> department heads should cooperate fully as far as providing <br /> Council with the information so that the Council can make policy. <br /> The biggest complaint by the Council at times is that the <br /> department heads do not share information, so how can they make <br /> policy?
