JUVIK : Why don' t they just do it on their own? <br /> IBARRA : Okay. One of the. . .the County gets its authority <br /> in establishing a structure of government , as under the state <br /> constitution, Section. . .Article 7, which states that the. . .I just <br /> mentioned previously , that the County as far as the <br /> mayor. . .establish. . .the Charter form of government and, in the <br /> area of structure , administration and organization. The County <br /> Charter can establish whatever form of government in which the <br /> County (inaudible) . So what I'm saying is , if you feel you want <br /> to revamp your Planning Department by following Honolulu ' s, amend <br /> the Charter. <br /> JUVIK : The state does not preclude us from doing that? <br /> IBARRA: No. <br /> JUVIK : But if we want to create a sanitation department, <br /> and separate that from Public Works , we could do that? <br /> IBARRA : Yes. <br /> BETHEA : Yep. <br /> IBARRA : Yes. But it has to be by Charter. You cannot do <br /> it by ordinance unless the Charter says , by . . . sometimes you don' t <br /> want the Charter to be so exact, because the Charter Review comes <br /> up every ten years , and sometimes , deliberately , you want to make <br /> it ambiguous and. . . so that you can fit in situations that you <br /> haven 't foreseen. And certainly , well , you can leave it open by <br /> saying that the structure shall be pursuant to ordinance. And the <br /> ordinance then, the County Council would establish the form. And <br /> that is easily amended. <br /> But there are certain providions , and I ' d really like to <br /> touch on real quick, that I ' ve seen as managing director, when we <br /> talk about the, I don ' t say fight , but I say maybe the debates <br /> between Council and the administration. . And I' d like to point it <br /> out real quick where you folks may want to look at in the review, <br /> is the section pertaining to appropriation and transfer within an <br /> agency. Okay. The basic financial procedure is the mayor would. . . <br /> BETHEA: What ' s that section? <br /> IBARRA : Okay. 10-8. 10-8, right there. It says to the <br /> extend that there are no available. . . Wait a minute. Let ' s see. <br /> 10-9, right here. The mayor excuse me, 10-9. Second paragraph, <br /> Bob. The mayor may at any time during the fiscal year transfer <br /> part or all of any unincumbered appropriation balance between <br /> classification or expenditure. <br /> Okay. Now the procedure, of course, is, and the argument on <br /> both sides is, that the administration would come before the <br /> Council and represent to the Council that these are the monies <br /> that we need.
