the commission are, and the personnel director and so <br /> forth, I don' t it ' s improper to specify what the <br /> commission believes to be the (inaudible) as long as it ' s <br /> not inconsistent with state law. And what we have <br /> proposed is not consis. . . inconsistent at this time. <br /> I might move on to item 4 , that pertains to Article <br /> 7; that is , we propose to remove "the designation of <br /> primary and secondary responsibilities with respect to <br /> the duties of the Personnel Director. The most important <br /> duty of the Personnel Director is to administer the <br /> personnel program in accordance with. . . civil service law" <br /> which is the merit system, "which includes many <br /> activities. His duties should, therefore, not be cate- <br /> gorized as primary and secondary. " And you' ll notice in <br /> Section 7-1.4 , powers and duties and functions of the <br /> director in the Charter now, it says that , "The major <br /> duties shall be in the areas of equal employment oppor- <br /> tunities , personnel development , personnel deployment , <br /> personnel relations and personnel welfare" and secondary <br /> duties shall be in other things . <br /> And the other things is the administration of the <br /> civil service system. I believe that my most important <br /> duty is to administer the civil service system, the merit <br /> system of the state and the County. And that my duties <br /> should not be categorized as primary and secondary, and <br /> that it is there reflected by our proposal . Again, if <br /> you have any questions on this part , I 'd like to attempt <br /> to answer them. <br /> CUSHNIE: I will ask. . . <br /> BETHEA: Yes. <br /> CUSHNIE: . . .a question if I may, since the wording <br /> of merit system has come up. We have Section 7-1 . 2. I <br /> find it unusual to see such subjective wording as "the <br /> members" of the commission "shall" be. . . "all be in <br /> sympathy with and believe in the principles of the merit <br /> system in public employment. " Is that a necessity, and <br /> how do you determine whether someone is in agreement with <br /> your merit system? <br /> LUKE: (Inaudible) answer. I guess you can' t assess <br /> that unless you interview the commissioner or respective <br /> commissioner before proposing an appointment and get the <br /> assurance that they shall be in sympathy with the merit <br /> system. So, I really don' t know how to answer that. <br /> I. . . if. . . I 'm sorry, I . . . this may also appear in the state <br /> law. And I 'm sorry I didn' t research this out . <br /> CUSHNIE: I just wondered if you. . .did it have it in <br /> the statutes?
