BETHEA: I think Mr. Luke is correct , but let ' s take <br /> a look at it. Let me just ask you. . .so at least I under- <br /> stand what you' re talking about , the status shall be in <br /> accordance with civil service laws; and you make that <br /> recommendation with respect to Section 5-1.4 (b) . With <br /> respect to that , it looks like it ' s just a typographical <br /> error. Shouldn' t that also say, "appoint and remove <br /> necessary staff"? It doesn' t say it in the Charter and I <br /> presume it should say it , just as it says that in Section <br /> 4 . 5 (a) . In other words , to appoint and remove a deputy <br /> with respect to the mayor ' s power , it should be appoint <br /> and remove necessary staff for which appropriations have <br /> been made by the Council . Would you agree that . . . <br /> LUKE: I know. I know. (Inaudible. ) <br /> CUSHNIE: Well . . . <br /> BETHEA: Well , I think we need to. . .we simply need <br /> to note that as another correction that we should make. <br /> Unless somebody disagrees that if the mayor can appoint <br /> the staff, he should be able to remove them. <br /> CUSHNIE: But we 've gone through questioning on <br /> removing civil service employees. The mayor cannot just <br /> turn around and (inaudible) civil service employees. So <br /> doesn' t that limit him in his ability to remove someone? <br /> L'ORANGE: These are exempt from civil service. <br /> GREENWELL: These are personal staff. <br /> L'ORANGE: Both. . . <br /> CUSHNIE: He' s asking that they be in accordance <br /> with civil service. . . I agree with you Pete. I think that <br /> this is going to be limiting in many areas that we need <br /> to be more sensitive to. <br /> BETHEA: If I may, I think the point is that under <br /> the civil service laws , the department heads of the <br /> counties may appoint and remove, hire and fire, a deputy <br /> or an assistant without reference to the termination <br /> procedures under civil. . .under the civil service law. <br /> However, they must be classified and paid according to <br /> the classification provision. I also assume that with <br /> respect to Section 5-1 .4 (b) , where it says , "Appoint <br /> necessary staff for which appropriations have been made <br /> by the council , " that the mayor has the power to appoint <br /> and remove and that these people, likewise, under <br /> existing civil service law, may be subject to removal <br /> without reference to the other provisions. So all we ' re <br /> really saying is that they need to be properly <br /> 369 <br />
