KANUHA: Yes, in response to that , two of these <br /> suggested amendments were changed by ordinance since the <br /> last review. The one related to the State Land Use <br /> Commission, however , I believe was still . . . it ' s an <br /> original provision. <br /> BETHEA: Yeah. What I was suggesting is whether or <br /> not , for example, it was ever raised an an issue, <br /> considering the Charter was the County Council had the <br /> power to abrogate to itself powers that were granted by <br /> Charter to the Planning Commission? In other words , I 'm <br /> raising the question. Suppose it ' s a planning. . . suppose <br /> it ' s a. . .as a matter of Charter (inaudible) , they said <br /> no, the County Council doesn' t make these zoning <br /> decisions; they' re made by the Planning Commission; and <br /> the County Council validates. If it said that , I don' t <br /> know that a County ordinance would be effective. What it <br /> appears to me to be is that with respect to these <br /> changes , that are made necessary because someone had <br /> decided that the County Council by ordinance could take <br /> from the Planning Department or the Planning Commission, <br /> decision-making authority which the Charter had granted <br /> to the Planning Commission. Does anybody here. . .do you <br /> follow what I mean? <br /> GREENWELL: I don' t think the commission has that <br /> power. I think it only has the power to advise or <br /> recommend to the Council on. <br /> KANUHA: Yes , that ' s their role. The primary <br /> function is to recommend to the Council , particularly in <br /> terms of legislative-type actions , rezonings primarily. <br /> L'ORANGE: Mr. Chairman, I think it was just that an <br /> oversight in language. It was just a semantics thing. <br /> As I recall , the Planning Commission never did rezoning, <br /> so they just always have a public hearing prior to the <br /> rezoning. <br /> BETHEA: Yeah. Well what I was wondering. . . <br /> L'ORANGE: (Inaudible. ) <br /> BETHEA: . . . is whether or not it would. When you <br /> look at these changes , it implies that there was some <br /> authority in the Planning Commission, which was deleted <br /> by some (inaudible) action. If there was not , then <br /> there' s no problem. <br /> L'ORANGE: I think the biggest changes , Mr. <br /> Chairman. . . I don' t have the old Council , but the last . . . <br /> but in the ' 79 Charter review, they made a big change <br /> 386 <br />
