• <br /> . � . <br /> COUNTY CHARTER <br /> • <br /> DEPARTMENT OF ENERGY (New Department} <br /> Section xx-1 Organization. There shall be a department of energy consisting of an energy <br /> commission,a manager and the necessary staff. <br /> Section xx-2 Energy Commission. The energy commission shall consist of nine members <br /> who shall be appointed by the mayor with the approval of the county council in the manner <br /> prescribed in Section 13-4. Commission membership shall be representative of the community <br /> and of the geographical areas of Puna, Ka'u, Kona, Kohola, Hamakua and Hilo with two members <br /> from Puna and not more than two from any of the above geographical areas. The manager of the <br /> department of energy, the planning director and the chief engineer of the county or their <br /> designated representatives shall serve as ex-officio members of the energy commission without <br /> power to vote. The energy commission shall: <br /> (a) Adopt rules and regulations which shall have the force and effect of law relating to the <br /> development of energy resources and the transmission and distribution of electrical energy <br /> over,across and under the County of Hawaii. <br /> (b) Have the power to establish and/or manage,control and operate an electric utility as a <br /> consumer cooperative to generate,transmit and distribute electric energy throughout the <br /> County of Hawaii. <br /> (c) Adopt an annual operating and capital budget for the department, subject to the hearing <br /> and advertising provisions of Section 10-4. <br /> (d) Have the power to acquire by eminent domain, purchase, lease or otherwise,and to <br /> sell, lease or otherwise convey real property in the name of the energy commission. <br /> 548 <br />
