From: Yuen on 01/04/90 <br /> COMMITTEE REPORT ON POLICE DEPARTMENT <br /> The Charter Commission has heard forceful testimony from the <br /> police commission and the chief of police that the present <br /> Charter provisions on the police department should be revised. <br /> Your Committee addressed four major topics in its <br /> discussions over the police department: <br /> (1) the power of the police commission to investigate <br /> public complaints of police misconduct; <br /> (2) the responsibilities and powers of the police <br /> commission and the police chief; <br /> (3) the procedures for removal of the chief; and <br /> (4) political activities by police officers. <br /> Your Committee has prepared a draft revision to the Charter, <br /> with alternative provisions, for the consideration of the full <br /> Charter Commission. Because Charter language is necessarily <br /> brief and general, your Committee has also prepared this report <br /> •to give the full Charter Commission a fuller understanding of the <br /> considerations that underlie the draft revision. If the Charter <br /> Commission chooses to recommend a revision of the Charter to the <br /> voters, your Committee suggests that it also adopt a report of <br /> the reasons for the changes. Such a report will educate the <br /> public as well as provide a source document in case of future <br /> questions over the interpretation of the Charter. <br /> 1. Investigate Public Complaints. Your Committee concurs <br /> with the recommendation of the present chief and of the present <br /> police commission that the police commission be given the power <br /> to investigate charges of police misconduct brought by members of <br /> 759 EXHIBIT C <br /> (11 pages) <br />
