F. Motion No. 8 : Ms. Cushnie moved that we adopt <br /> 7-2. 2(c) as is , seconded by Dr . Juvik. There was no <br /> discussion. Motion Count : All were in favor and the <br /> motion carried. <br /> G. Motion No. 9 : Ms . Cushnie moved that we adopt <br /> 7-2. 2(d) as is . <br /> Mr. Greenwell seconded. There was no <br /> discussion. Motion Count: All were in favor and the <br /> motion carried. <br /> H. Motion No. 10: Ms. Cushnie moved that we adopt <br /> 7-2. 2(e) as is , seconded by Mr. Greenwell . There was <br /> no discussion. Motion Count : All were in favor and <br /> the motion carried. <br /> I . Motion No. 11 : Mr. L'Orange moved that we adopt <br /> 7-2. 2 (f) as is , seconded by Mr. Greenwell . There was <br /> no discussion. Motion Count : All were in favor and <br /> the motion carried. <br /> J. Motion No. 12: Mr. Greenwell moved that we adopt <br /> the Sec. 7-2. 2 (f) , 2nd paragraph, "Except for purposes <br /> of inquiry, neither the commission nor its members <br /> shall interfere in any way with the administrative <br /> affairs of the department. " This motion was seconded <br /> by Mr. L'Orange. <br /> Discussion: Cushnie: Testimony requested that <br /> we delete "in any way" because the commission does <br /> interfere in administrative affairs of the depart- <br /> ment , and examples were cited. Yuen: Has some <br /> concern. You could add , "Except for purposes of <br /> inquiry, and as otherwise stated in the Charter. . . . " <br /> Both the commission and police chief want that wording <br /> to remain in the Charter. Reason: They don' t want <br /> the commission to run the department. <br /> Motion Count: All were in favor of the motion; <br /> motion carried. <br /> K. Discussion on 7-2 . 3 , alternatives A and B: Lum: <br /> Alternative A is the Police Commission' s preference. <br /> Alternative B is police chief ' s preference, containing <br /> "statement of reasons . " Bethea: Difference is in <br /> alternative B, must give reasons and a hearing. <br /> Yuen: Correct. Reason statement of intent appears in <br /> alternative B is to avoid any interpretation problem. <br /> Alternative A is clear. Bethea: Don' t even need <br /> "without cause being stated" in alternative A. Yuen: <br /> Correct. Police Commission requested that wording. <br /> 738 <br />
