Robert Bethea , Chairman and Commissioners <br /> Hawaii County Charter Commission <br /> 25 Aupuni St . <br /> Hilo , Hawaii 96720 <br /> Gentlemen and Ladies , <br /> The following are proposed amendments to the Hawaii County Charter , <br /> which would address existing and potential problems in the process- <br /> ing of Initiative and Referendum, (Article 11) as well as Charter <br /> Amendment or Revision (Article 15 ) petitions . <br /> Article 11 - Initiative and Referendum <br /> 1 . Section 11-3 (a) & (b) - Set the submission date no <br /> later than May 1 of an election year . <br /> a . Present charter language does not guarantee the <br /> placement of qualified petitions on the ballot of <br /> the next general election due to the council ' s as <br /> well as state ' s ( election) mandated deadlines not <br /> being met . This proviso will correct this situa- <br /> tion. <br /> 2 . Section 11-3 ( c) - Add sub-section to define a quali- <br /> fied voter as one 'who is duly registered before or on <br /> the day that the clerk begins his examination. <br /> a . Challenges in this area have caused major problems in <br /> the past . <br /> 3 . Section 11-5 - Delete entire section 11-5 (d) . <br /> a . Such an allowance has had little significance in <br /> the past . <br /> b . In its place , add "The clerk shall disregard all <br /> signatures dated prior to the last general elec- <br /> tion" .
