If something comes up in <br /> which the person has significant financial interest , the <br /> ethical course would be to not vote. <br /> Ms. Poppe moved to adopt the recommendation made by Mr. <br /> Giannini to replace Sect. 14-2 (c) . Mr. L'Orange seconded <br /> it. <br /> Ms. Cushnie expressed concern that in some cases county <br /> employees should divest themselves of business interests <br /> that created a potential conflict as required by the <br /> present Sect . 14-2(c) . <br /> Vote on Sect. 14-2(c) . Poppe, L'Orange, Lum, Greenwell , <br /> and Bethea favored the motion. Juvik, Cushnie, Omonaka, <br /> and Nishikawa opposed. Motion failed because it did not <br /> obtain the necessary six votes. <br /> Mr. Juvik moved that Sect. 14-3 (a) be amended so that <br /> members of Boards and Commissions , as well as County <br /> Council members , would be required to declare possible <br /> conflicts of interest before voting. Ms . Cushnie seconded <br /> the motion. Vote on the motion: Juvik and Cushnie <br /> favored , all others opposed. Motion failed. <br /> IX. DISABILITY OF MAYOR <br /> Bethea: It is commonsense that if Mayor is temporarily <br /> disabled, mayor resumes his or her powers by taking any <br /> official action. Mayor does not have to sign some <br /> document taking power back from managing director. Feels <br /> no change is required. <br /> Mr. L'Orange made a motion not to change Sect. 5-1. 6 . All <br /> were in favor. <br /> X. GEOGRAPHICAL AREAS <br /> Mr. Bethea brought up the fact that the Charter treats <br /> geographical requirements for boards and commissions in <br /> two ways. Some require residency in specified districts , <br /> which correspond with the island' s judicial districts. <br /> Others mention residency in "geographical areas" of Hilo, <br /> Hamakua, Kohala, Kona , Puna, and Ka 'u. These are not <br /> defined. Apparently county practice has been to equate <br /> these "geographical areas" with the judicial districts so <br /> that someone living in North Hilo does not qualify for a <br /> Hamakua seat. <br /> • <br /> 939 <br />
