Miyashiro, Chairman, Ethics Board Ltd", <br /> Due to business commitments, I am unable to attend your hearing as scheduled. <br /> However, pursuant to your request for comment on the Code of Ethics, Article <br /> 8, Chapter 2 of the Hawaii County Code, the following are matters which have <br /> been brought to the Board's attention and should be given your due consideration: <br /> 1. Transmittal from Corporation Counsel regarding amendments to <br /> comply with the decision rendered by the Third Circuit Court <br /> on the constitutionality of Sections 5-C, 8A, 8B, 8C and 9. <br /> It is recommended that Sections 5-C and 9 be deleted and that <br /> Sections 8A, 8B and 8C be amended to include a provision as <br /> follows: <br /> "This section shall be construed together with <br /> Section 13-20(b) of the Charter of the County of <br /> Hawaii. The Board shall make an affirmative or <br /> negative finding that the subject involves personal <br /> matters affecting the privacy of an individual." <br /> • <br /> Should this provision be acceptable, references to confidential <br /> proceedings in these sections should be deleted. <br /> 2. County Council's acceptance of County Clerk's recommendation to <br /> delete the words "without proper consent" at the end of the sentence <br /> in Section 7A. <br /> 3. Councilwoman Lai's recommendation as follows: <br /> a. Section 6 be amended by deleting the words "hiring, appointment <br /> or election" and inserting in its place, "assumption of duties <br /> and responsibilities." <br /> b.
