CHIEF PAUL: No. To my knowledge there has been <br /> no official interpretation. Nothing from any of the agencies. <br /> MR. ISHIDA: Then I take it that it is the <br /> department' s position, although they have nothing officially done, <br /> that you have interpreted this position to be ambiguous, and that <br /> you feel that this position has in effect created a situation <br /> where you find yourself in a predicament where should there be <br /> conflicting instructions or request from the commission and the <br /> mayor you are in a quandry as to which should govern. <br /> CHIEF PAUL: You put your finger right on it. That' s <br /> exactly it. <br /> MR. ISHIDA: The only thing I want to make sure is <br /> clear is that the department has made their own conclusion or <br /> determination or interpretation of this provision that that is <br /> in fact the situation. <br /> CHIEF PAUL: That' s correct. <br /> MR. ISHIDA: This I think applies to the other two <br /> departments under the commission, this Section 7. Since we do have <br /> this catch-all phrase at the end of each of these provisions and <br /> I think its a valid point. I think it' s going to be very beneficial <br /> as far as the commission is concerned that we get minutes of this <br /> particular area of the three charter commissions to find out <br /> exactly, in our mind, if we can ever develop it. Maybe as, Chief <br /> Paul has indicated, the results may be what he got from the <br /> commission members where it' s still ambiguous. And if that is so, <br /> it might be incumbent upon us to clarify. <br /> CHAIRMAN SAKATA: Mr. Ishida, I think probably <br /> this should be cleared up through the Corporation Counsel' s Office, <br /> to see how this things works and I think we can have clarification <br /> on this. <br /> MR. ISHIDA: The thing is, will the Corporation <br /> Counsel be able to make a legal interpretation of it? The only <br /> thing is I think it would be incumbent upon us to read the minutes <br /> of the past charter minutes to make our own determination to see <br /> whether in fact how we should interpret it. <br /> MR. SENSANO: In the day-to-day operation, Chief <br /> Paul, now I read this word supervision. If my supervisor. is working <br /> with me, it' s going to be with me everyday. Now, which group do <br /> you work with, the commission or the Mayor. <br /> CHIEF PAUL: I work with the commission. <br /> MR. SENSANO: So actually, they are the ones that <br /> supervise, isn' t that right? If I read the term supervision <br /> correctly and if I understand the meaning of the word supervision. <br /> CHIEF PAUL: That is correct. Yes sir. <br /> MR. TRULSON: Chief Paul, Section 7-2. 7 , as stated, <br /> the police department shall come under the general supervision and <br /> control of the police commission, that would more suit your desires? <br /> - 18 - <br />
