BESS : Well , let me start off by saying <br /> that I don ' t know a great deal about the city manager form <br /> of government. Assuming that the city manager form of <br /> government left me with one boss which I think the little <br /> I do know about city manager government, that is unlikely <br /> to happen because you are still going to be accountable to <br /> each member of the council and you are still going to run <br /> into a lot of political demands being made on you. <br /> Let me understand this , the city manager <br /> would have the power to hire and fire a corporation council <br /> and with no fall back to the councilmembers who appointed the <br /> city manager as far as confirmation. Is that the setup that <br /> you envision? <br /> MR. CADINHA: I 'm trying to draw an analogy <br /> with a public corporation, that ' s all. If that ' s.. thecase <br /> that:1s how it woUId-work. Under a public corporation if <br /> the president decides it doesn ' t need it 's old counsel any <br /> longer so he fires the guy and hires someone else. <br /> MR. BESS : Well , certainly, if you were just <br /> accountable to one person it would make my job much easier. <br /> And like 'I say, as far as the city manager form of government <br /> is, I don ' t know that, in fact, that is the case that I would <br /> be accountable to one person. I think though that what you <br /> have to recognize is that it has been placed and the problem <br /> has been defined as my representing the council as well as <br /> the mayor. <br /> The problem goes much beyond that. Weare <br /> faced with. . .because we have the duty of representing all the <br /> agencies of the county. . .I represent the Water Commission, <br /> I represent the Water Department, I represent the Mayor as <br /> well as the council . But in the Water Department situation <br /> there may be a conflict between representing both the depart- <br /> ment and the Water Commission that, you know, I may find out <br /> some things through the Water Department that I may feel <br /> should be disclosed to the Water Commission and yet, at the <br /> same time, I have an attorney-client relationship with that <br /> Water Department. You constantly have this balancing going <br /> on. <br /> I don ' t know how the city manager form of <br /> government t,ou;ld work but assuming that. .I don ' t know if you <br /> would have any commissions in that situation, would you have <br /> commissions still in the city manager form of government? <br /> I don ' t know. But what I am suggesting is that even if the <br /> city manager form of government also contained commissions <br /> I would still be in a very difficult position in the sense <br /> that I would be not only-representing the city manager but <br /> the water commission and the department itself. I hate to <br /> even get into the city manager area because I know so little <br /> about it and the last time I can remember anything about <br /> city manager form of government was when Patsy Mink came to <br /> us and talked to me in the 10th grade about the City and County <br /> of Honolulu. <br /> -29- <br />
