MS. ISBELL: Well, if we elected him then we <br /> are stuck with him. I mean if it is that fine of a line and <br /> he won ' t resign and he won 't put an appointment in and the <br /> doctor can ' t make that decision , you are going to have to work <br /> with him. The other councilmen are going to have to.' We are <br /> not in the position to make his decisions for him. If the <br /> doctor says that he is functioning and he says that the man <br /> can make his own decisions , we cannot take that away from <br /> him. He was elected and he has those years to run. <br /> MR. SENSANO: So it may be then that this <br /> person may continue in office even though you think he may <br /> not be capable. <br /> MS. ISBELL: There is always that possibility. <br /> But we are really speaking of the catastrophic sort of thing <br /> happening. <br /> MR. SENSANO: You mean certain types of <br /> illnesses. In other words where it is demonstrated that this <br /> man is not physically capable of attending meetings and things <br /> like that. You know, not all illness is confined to physical <br /> illness. Sometimes the results are serious or even more <br /> serious. <br /> MS. ISBELL: You are speaking really of mental <br /> illness. That_,is something that we must live with. If the <br /> person cannot discern that he needs to_ make an-_.interim;,appoint- <br /> men-t or- if--the doctor feels that he cannot absolutely say that <br /> he canhot- make his own decisions then you must either use <br /> impeachment or live with him until the end of his term. <br /> MR. SCHUTTE : With regards to the same section <br /> will you try to do this and tie it down so that by law an <br /> individual who cannot perform he has no other recourse but to <br /> be removed from office. . . . . <br /> MS. ISBELL: No, you could never do that. <br /> It would have to be as an interim appointment unless he <br /> resigned. <br /> MR. SCHUTTE: In this particular instance <br /> now if he has the opportunity and I think Cluney from Molokai <br /> wasin the same position. He felt he could not continue his <br /> duties as a councilman and as a result he resigned from the <br /> council--in this case here that would solve all of the <br /> problems. <br /> MS. ISBELL: It is really better if they <br /> would resign, right. <br /> MR. SCHUTTE: So I am only assuming then'. that the <br /> councilman_ that you are possibly referring to does not feel that he <br /> is is continuing and as a result does not want to <br /> resign. . <br /> - 24 - <br />
