It is possible that during the first six months of <br /> a term, we might not have a good councilman. However, if he <br /> waged a campaign worthy of his becoming elected, it isn ' t <br /> often throughout this great land of ours that we find the <br /> person that wages a good campaign and gets elected that <br /> doesn ' t do a fair representative job. There are just not <br /> really poor legislators. <br /> CHAIRMAN SAKATA: You think a one year honey- <br /> moon is ample enough? The charter does take <br /> into account death and how that appointment will be made. <br /> Probably one of the reasons we didn ' t put language into our <br /> proposals was how to write the language to cover what_`°,that parti- <br /> cular situation is going to be what we felt would be a delicate <br /> task. How do you decide whether a councilman or elected rep- <br /> resentative is incapacitated and cannot fulfill his position as <br /> such. Of course, we are all specifically talking about Farmer <br /> Bill and his unfortunate situation right now. However, I have <br /> seen Farmer Bill at a few meetings in Kona, recently, so we <br /> know he is up and around. Is he really incapacitated? <br /> However, the purpose for it being in there is that is a situation <br /> that is unique in itself and each situation would practically <br /> be a situation within itself. If a councilman had a severe <br /> stroke that left him totally paralyzed for the remaining period <br /> of his office time, there is no way you can make that change <br /> in the charter at this point. It just isn ' t written into the <br /> charter and the only thing that can happen is that the other <br /> councilmen can say we will help cover this man ' s position . <br /> We will come out and see you in your district and we will try <br /> to help. But it really gives you lack of representation from <br /> your district. At that point, possibly, without going into an <br /> election again , at least until such time as the term of office <br /> was to expire when an election would be held, possibly a <br /> mayoral appointment or a unanimous council appointment to <br /> that position. We really didn ' t know. We just feel that <br /> there should be some provision in there that could cover it. <br /> - 21 - <br />
