MR. TRULSON: What do we presently have for <br /> impeachment, according to law? <br /> MR. ODA: Based on Section 62-13. . .When you <br /> say according to law that is what they were referring to. <br /> Only twenty-five. So the draft which I have, which was typed <br /> up, is a compressed version of 62-13 under the Hawaii Revised <br /> Statutes. <br /> MR. TRULSON: 62? Oh, no, no, I meant in the <br /> charter. <br /> MR. ODA: There is nothing. <br /> MR. TRULSON: There is nothing, right. <br /> MR. ODA: It just says according to law. . .the <br /> mayor or the councilmen can be removed by impeachment according <br /> to law. <br /> MR. TRULSON: Well , when they say according to <br /> law, then they refer to the HRS? <br /> MR. ODA: Right, which we didn ' t know existed <br /> until several days ago. <br /> MR. TRULSON: So then, in essence, what we will <br /> really be doing with this will just be changing from twenty-five <br /> to one-hundred, basically. <br /> MR. ODA: Well and refining. . .kind of compressing <br /> the language a little bit. But in substance that is the basic <br /> thing. The number. <br /> MR. TRULSON: Where would we put that in? Would <br /> we put that in the. . . ®_like in the council ? in the mayor portion? <br /> MR. ODA: Article XIII under General Provisions, <br /> Page 29 and the pages following that, might be the best place <br /> to put it in. <br /> MR. TRULSON: Would it go in then like-that <br /> area is definitions. <br /> MR. ODA: I don 't mean 13. 1 but somewhere in <br /> Article XIII. <br /> MR. TRULSON: It couldn ' t go under like, in the <br /> case of the mayor' s section 5-1. 7, remove. . . <br /> MR. ODA: Well, because then you make it apply <br /> only to the mayor. You have to apply it to the council unless <br /> you want to repeat it in two separate sections. That is what <br /> I am trying to avoid. You already have a provision in each of <br /> those. .the mayor' s section and the councilmen ' s section that <br /> they may be removed by impeachment'.. proceedings as provided by <br /> law. . .you can say as provided in this charter and slap it under <br /> Article XIII. <br /> -18- <br />
