Perhaps you can amend that Board of Appeals <br /> and look into not only to procedural things but other area. <br /> MR. TRULSON: If we do it by charter there is <br /> less chance of ordinances popping up from now and the next ten <br /> years. I think we should make it tougher to have anybody come <br /> in with an ordinance however they want to word it. Whereas, <br /> if we have it in the charter, it can be a much stiffer Board <br /> of Appeals. Much stronger, I would think. <br /> MR. SCHUTTE : i think this is fine because <br /> there is this other appeals board. My only concern is is it <br /> compatible to the planning portion. . . . .that was my only <br /> concern. As far as consolidating. . . . . <br /> MR. TRULSON: But like Mr. Oda stated there are <br /> going to be "experts" testifying on their own behalf, either <br /> pro or con, so we have to anticipate that the commissioners <br /> are going to be fairly intelligent and be able to judge the <br /> evidence that is given to them. <br /> MRS. KOBAYASHI : And if I remember from what <br /> Mr. Fuke said, he said in two years they had six meetings, <br /> six appeals of the Planning Board and I would assume that Public <br /> Works one didn ' t have very much more. So, if you are only <br /> having six meetings in two years. . . <br /> MR. TRULSON: We don ' t know. We don ' t know about <br /> the board. We don ' t know what they have done, right? <br /> MR. OMONAKA: There is a need for this body to <br /> give the citizens of a community a chance to, you know, instead <br /> of going to court as a resort. This appeals board, I think, is <br /> needed as one more shot for the guy. So, even though it has <br /> hardly been used, I think that commission should stay there. <br /> Separately. <br /> MRS. KOBAYASHI : I thought that maybe if we <br /> combined them they would meet more often. <br /> MR. TRULSON: Mr. Chairman. I would like to <br /> make a motion that we accept Section 5-6.3 and amend it to the <br /> charter as proposed by Mr. Oda. <br /> MRS. KOBAYASHI : I second the motion. <br /> CHAIRMAN SAKATA: It has been moved and seconded <br /> that Section 5-6.3 Board of Appeals as proposed by legal counsel <br /> be accepted and retained under Chapter 6 Miscellaneous. Any <br /> more discussion on this? <br /> MR. ISHIDA: Mr. Chairman. Akira, on this do <br /> you feel that a Board of Appeals should be retained just <br /> strictly under the Planning Department? That this dual capacity <br /> board , as proposed, will not serve its purpose? <br /> -30- <br />
