The intent of the <br /> motion, then, is to delete Section 5-4.4 and combine only. <br /> It has nothing to do with any other section with regard to <br /> Planning Director or the Planning Commission. <br /> MR. SCHUTTE: The motion then is to delete <br /> Section 5-4.4 and add Section 5-6.3. <br /> CHAIRMAN SAKATA: The Board of Appeals would not <br /> be in the Planning Department section but would be under the <br /> Miscellaneous section, Chapter 6. Section 5-6.3. <br /> MR. OMONAKA: Some more discussion, Mr. Chairman. <br /> Stuart , can you explain that. . . "The board of appeals shall hear <br /> and determine appeals from the actions of the director and <br /> planning commission as permitted by law"? <br /> MR. ODA: Well , whatever the charter says is <br /> appealable, the board can hear. In other words, if the Planning <br /> Director makes a. . .processes an application to the Planning <br /> Commission and from there the guy is not satisfied with the <br /> decision, that means he can appeal it under the charter through <br /> the planning. . . . <br /> MR. OMONAKA: Then , by virtue of adopting this <br /> proposal then ,- the intent is to go from the Planning Director <br /> through the Commission, then to the Board. Is this right? <br /> MR. ODA: Right. <br /> MR. OMONAKA: So then you are changing the <br /> concept, a little bit, by adopting this? <br /> MR. ODA: Right. There will be another. . .Planning <br /> Commission.
