Comm. 70 : Letter from Representative Herbert Segawa, <br /> dated June 12, 1979 , submitting suggestions <br /> for charter revision. <br /> Comm. 71 : Synopsis of the functions of the Hawaii County <br /> Pension Coard as presented to the Commission, - <br /> on June 12 , 1979. <br /> Motion was made by Mr. Schutte <br /> to receive and file Communications <br /> 67 through 71. Seconded by <br /> Mr. Yagong and unanimously carried. <br /> BUSINESS CHAIRMAN. SAKATA: The business of the day is <br /> OF THE DAY: to receive the report from the subcommittee <br /> on Article III , Legislative Branch, County <br /> Council. <br /> MR. ISHIDA: As far as the subcommittee is <br /> concerned , we don ' t have a written report. We actually finished <br /> our thing this afternoon so I will be giving an oral report. <br /> If you will turn to your Article III , Legislative <br /> Branch, County Council , page 2 of the present County Charter. <br /> Basically, the provisions that we spent much time on is Section <br /> 3-2. There are some revisions on the other sections. However, <br /> I will restrict myself right now initially to Section 3-2. <br /> Composition and Terms. <br /> Through the testimony that we have had and that <br /> was digested by the subcommittee, the subcommittee was of the <br /> opinion that we are somewhat mandated by the testimony given <br /> before us to effect some type of district representation. <br /> We were informed, or we were asked to consider <br /> possibly up to nine different districts, each being represented <br /> by one council member and we had modifications thereafter <br /> concerning the number of districting. Now, as far as the <br /> subcommittee was concerned the problem that we were faced with <br /> as far as coming up with nine single districts was that we do <br /> not have, or nothing was presented to us to base any districting <br /> into nine different districts. We were given by one of the <br /> committees, one of the groups from West Hawaii using the <br /> registered voters as a basis upon which to determine different <br /> districting. Legal counsel has already informed us that he <br /> felt in his opinion that such basis would not be valid. <br /> Consequently, the subcommittee disregarded that basis. The only <br /> other basis which the legal counsel stated would probably be valid <br /> would be based upon population and census. The only census <br /> information of course we would have would be the last federal <br /> census which was in 1970. I think we were of the opinion that <br /> 1970 was somewhat too far gone so that would definitely not be <br /> valid. However, the only alternative that was available to the <br /> subcommittee concerning districting is using the present State <br /> Representative districting. That may be questioned, however, <br /> but since the districting is in existence, we were informed by <br /> -30- <br />
