Does everyone understand the intent <br /> of the motion? <br /> Ayes - Omonaka, Sensano, Noes - Trulson - 1 <br /> Yanaga, Cadinha, Absent - Yagong - 1 <br /> Ishida, Schutte, <br /> Iwamoto, Kobayashi , <br /> Sakata -9 <br /> Carried. <br /> WATER DEPT: According to the handout, the Department of <br /> Water Supply is under Article V, Chapter 6. <br /> MR. ODA: As an executive department. <br /> ARTICLE IX: CHAIRMAN SAKATA: We will go into Article IX, <br /> Prosecuting Attorney. <br /> MR. ODA: What will happen to Article VIII? <br /> Which was the former Department of Water Supply. <br /> MR. ISHIDA: It has been deleted. <br /> MR. SCHUTTE: If wedelete it, would it be proper <br /> to move (Article IX and make that Article VIII? <br /> MR. ISHIDA: I ' think we should just leave it up <br /> to the legal counsel as he redrafts to renumber these things. <br /> MR. SCHUTTE: Mr. Chairman. Stuart, on Section <br /> 9-2. Qualifications. Again, it makes mention of an attorney <br /> licensed to practice and in good standing before the supreme <br /> court in the State of Hawaii. Did we make a change on that <br /> so that everything would be. . . <br /> MR. ODA: No, I think we are conforming it to <br /> this language. The thing I would recommend , Mr. Chairman, is <br /> that two years be changed to one year, as the others. That is <br /> the last sentence of that section. <br /> MR. TRULSON: Mr. Chairman. I would like to <br /> refer to Communication 415 where Mr. Ono gave us quite a list <br /> of possible changes or amendments. Many of them which were, <br /> forgive me for the lack of „the `word. . .an example such as <br /> changing /magistrates7 to make it judges. The present wording <br /> like Section 9-4 (d)—would be to insert instead of magistrate, <br /> judges, wherever the word magistrate is. <br /> There is one other section that he had an <br /> extensive amount of input and I would like to refer to our <br /> counsel regarding proposed Section 9-5, Staff. He proposes <br /> a subsection (b) The prosecuting attorney may appoint <br /> investigators who shall have all the powers and piv <br /> rileges <br /> of a police of of the county. That was for subpoena <br /> powers mainly what he considered was for minor offenses, but <br /> it would appear to open up quite a bit of subpoena power to <br /> perhaps people who shouldn 't have it. <br /> -15- <br />
